Terms of Service

These Terms of Service ("Terms") govern your use of sendrishta.com and its related services (the "Service"). The Service is operated by Shubham Pansare, trading as SendRishta, based in Mumbai, India ("SendRishta", "we", "us" or "our"). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

SendRishta lets you create a matrimonial biodata, fill it in yourself or with the help of AI, share it through a link, see how often and from where it is viewed, and download it as a PDF for a fee. SendRishta is a biodata tool. It is not a matchmaking or marriage bureau service: we do not introduce people, verify the identity of users, or check the accuracy of what anyone writes in a biodata.

To use the Service, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Use only one account per person
• Not impersonate any other person or entity

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• Your content, your responsibility. You are responsible for everything you put in your biodata. If you include information or photos of other people, such as parents, siblings or relatives, you confirm that you have their permission.
• Anyone with the link can view it. A shared biodata, including its photos and contact details, can be opened by anyone who has the link, and can be forwarded by the people you send it to. Link previews on messaging apps show your name, a photo and a few key details. Share the link only with people you trust.
• Creating a biodata for someone else. If you create a biodata for a family member, you confirm that they are an adult and have agreed to it.
• Viewer statistics. The Service shows you when your biodata was viewed and the approximate location, device and browser of each view, as described in the Privacy Policy. You may use this only to follow the response to your own biodata, not to identify, track or contact viewers.

You agree to use the Service responsibly and in compliance with all applicable laws. You agree NOT to:

• Provide false, misleading, or fraudulent information
• Upload inappropriate, offensive, or unlawful content
• Create a biodata of a person without their consent, or of a minor
• Use the Service for fraud, extortion, marriage scams or to collect other people's personal data
• Violate any local, state, national, or international law
• Infringe upon the rights of others, including privacy and intellectual property rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated scripts, bots, or other automated means to access the Service, except an AI assistant you connect to your own account through the connection we provide
• Transmit any viruses, malware, or other harmful code
• Engage in harassment, abuse, or harmful behavior toward other users
• Use the Service for commercial purposes without our express written consent
• Reverse engineer, decompile, or attempt to extract source code from our Service

To run, improve and protect the Service, we collect information about how visitors and users use it. This includes where visitors come from, the pages and features they use, technical details of their device and browser, and session recordings and heatmaps on every page of the site, including biodata pages and the signed-in dashboard. We use this to improve the product and to detect, investigate and prevent misuse, fraud and security incidents. By using the Service you agree to this collection, which is described in detail in section 2 and section 3 of the Privacy Policy.

AI import uses a third-party AI model to read the text and files you submit and fill in your biodata. AI output can be wrong or incomplete: you are responsible for reviewing your biodata before you publish or share it. AI import is subject to usage limits, which we may change. Do not submit other people's documents without their permission.

• Price. Creating and sharing a biodata is free. Downloading a biodata as a PDF is a paid feature; the price is shown before you pay (currently ₹99 per PDF). All prices include GST.
• Payment. Payments are processed by Razorpay. Your card, UPI or bank details are handled by Razorpay under its own terms and are not received by us.
• What you get. A payment unlocks the PDF generated at that time. It remains available to download again from your dashboard. A PDF reflecting later changes to your biodata may require a new purchase.
• Refunds. Because the PDF is a digital product delivered immediately, payments are not refundable once the PDF has been generated. If you were charged but did not receive your PDF, or were charged more than once for the same PDF, email [email protected] within 7 days of the payment and we will provide the PDF or refund the extra charge. Approved refunds are returned to the original payment method, usually within 5 to 7 business days of approval.

Our collection and use of personal information, for you and for the people who view your biodata, is described in our Privacy Policy, which forms part of these Terms.

The Service and its original content, features, and functionality, including our biodata designs and templates, are owned by SendRishta and are protected by applicable copyright, trademark and other intellectual property laws.

User Content: You retain ownership of content you submit to our Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display and share it (including in link previews) solely to provide and improve the Service, and to our service providers as needed to do so. This license ends when you delete the content, except for copies we must keep by law.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

We strive to provide reliable service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time with or without notice. We may also impose usage limits or restrict access to certain features. We will not be liable for any modification, suspension, or discontinuation of the Service.

The Service relies on third-party services, including Google sign-in, Razorpay for payments, an AI model provider for AI import, and hosting, analytics and session-recording providers listed in the Privacy Policy. These services have their own terms and privacy policies, and we are not responsible for their practices. When you choose to use Google sign-in or pay through Razorpay, their terms also apply.

DISCLAIMER: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT VERIFY USERS OR BIODATA CONTENT AND ARE NOT RESPONSIBLE FOR ANY DECISION, INTRODUCTION, RELATIONSHIP OR MARRIAGE THAT RESULTS FROM A BIODATA SHARED THROUGH THE SERVICE.

LIMITATION: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENDRISHTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

TOTAL LIABILITY: OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹1,000, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless SendRishta and its operator, agents and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including the privacy of anyone whose details you include in a biodata; or (d) any content you submit through the Service.

Your Rights: You may close your account at any time by emailing [email protected] as described in section 9.

Our Rights: We may suspend or terminate your account, or remove a biodata, immediately and without prior notice, if you violate these Terms or engage in activities that we determine, in our sole discretion, to be harmful to our Service, other users or the people described in a biodata.

Effect of Termination: Upon termination, your right to use the Service will cease immediately and your shared biodata link will stop working. Data deletion following termination will be handled according to the process in section 9.

Governing Law: These Terms are governed by the laws of India.

Dispute Resolution: Before starting any formal proceedings, please contact us at [email protected] so we can try to resolve the issue informally. Any dispute that is not resolved within 30 days will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Mumbai, Maharashtra, and the proceedings will be in English. Subject to this, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.

Nothing in this section limits any right you have under the Consumer Protection Act, 2019 or other law that cannot be excluded by agreement.

We may modify these Terms at any time by posting the updated Terms on this page and changing the "Last Updated" date above. For material changes we will also notify signed-in users through the Service or by email before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SendRishta regarding the use of the Service and supersede all prior agreements and understandings.
